The clubs have been referred to an independent commission to investigate alleged breaches of profit and sustainability rules in their accounts for the 2022-23 season. According to the Premier League rules, clubs can only incur a maximum loss of £105m over a three-season period or £35m per campaign before facing penalties. Possible sanctions for breaching these rules include fines or points deductions. Everton is currently appealing a 10-point deduction from a previous charge. Both clubs have acknowledged their breach of the league's profitability and sustainability rules. The chair of the judicial panel will appoint separate commissions to determine the appropriate sanctions. The clubs have 14 days to submit their formal responses, and the hearings must be concluded within 12 weeks. Appeal hearings must be held before May 24, 2024, and the complaint resolved before June 1. The profit and sustainability rules consider clubs in breach if their losses exceed £105m, with a reduction of £22m for each season spent in the Championship. Nottingham Forest's maximum loss is £61m due to their two seasons in the Championship within the assessment period. The new reporting process requires clubs to submit their accounts by December 31, ensuring that any penalties are imposed during the season of the alleged transgression. The Premier League will continue to monitor the situation closely.
